The agreement promoters accept to sell tickets on Vybz Hub, covering fees, payouts, holds, cancellations, disputes and door sales.
This Promoter Ticketing Agreement applies when a promoter, organizer, or authorized event representative enables or uses Vybz Hub ticketing.
It supplements the Vybz Hub Terms of Use, Promoter/Event Organizer Policy, Refund & Event Cancellation Policy, and Acceptable Use & Prohibited Events Policy.
By enabling ticketing, the promoter agrees to this Agreement.
1. Promoter Authority
You represent that you are authorized to create, manage, promote, and sell tickets for the event.
You are responsible for obtaining permissions, licenses, permits, venue approvals, entertainment rights, insurance, tax registrations, and other legal authority required for the event.
2. Promoter Is the Event Organizer
Unless Vybz Hub expressly agrees otherwise in writing, you—not Vybz Hub—are responsible for producing and operating your event.
You are responsible for accurate event information, venue arrangements, performers and vendors, event safety and security, admission policies, age restrictions, staffing, accessibility obligations, legal compliance, attendee service, event changes, event cancellation, cash collected at the door, and promoter obligations arising from refunds, disputes, or chargebacks.
3. Ticket Setup
Vybz Hub may allow a promoter to configure up to the number of ticket tiers currently supported by the platform.
You are responsible for ensuring ticket names, descriptions, prices, quantities, purchase limits, availability, and event details are correct before sales begin.
Vybz Hub may restrict changes to ticket tiers after sales occur in order to preserve purchaser expectations, accounting accuracy, and ticket records.
4. Purchase Limits and Fair Access
Where ticket limits are configured, promoters must not encourage or assist users in circumventing those limits.
Promoters must not manipulate inventory, create artificial scarcity, use unauthorized duplicate sales channels to oversell the same inventory, or instruct users to evade platform controls.
5. Currency
Where supported, a promoter may configure ticketing in USD or JMD based on the promoter’s supported payment/payout arrangement.
Once ticket sales have begun, the event’s ticketing currency may be locked.
You must not attempt to circumvent the currency lock or misrepresent the currency of a ticket sale.
6. Online/Card Customer Fee
For applicable standard online/card ticket purchases, Vybz Hub charges the customer a 5% customer fee calculated from the ticket base amount.
The customer sees the applicable total before payment.
7. Promoter Fee
For applicable Vybz Hub-processed online/card ticket sales, Vybz Hub charges the promoter a 5% promoter fee calculated from the ticket base amount.
The promoter fee is deducted from promoter proceeds.
The promoter agrees that the customer fee and promoter fee are separate economic components even if the customer-facing checkout groups charges under a simplified “fees” presentation.
8. Payment Processing Costs
Where payment-processing costs are included within Vybz Hub’s configured fee model, the promoter will not separately charge the customer an undisclosed processor fee.
If Vybz Hub changes the fee model in the future, the updated terms or purchase/setup flow must disclose the applicable arrangement before it applies.
9. Door Cash — No Vybz Hub Fee
For an authorized door-cash sale:
- customer fee = 0%;
- promoter fee = 0%;
- platform fee = 0%;
- processor fee = 0%;
- future Vybz Hub payout = 0.
The customer pays the exact configured cash ticket price. The promoter or authorized event seller receives and controls the physical cash directly.
Vybz Hub records the sale for inventory, ticket issuance, and event operations but does not hold the cash and does not owe a later payout for that cash sale.
10. Door Card Sales
Where door-card sales are supported, they are electronically processed and subject to the applicable card fee structure shown by Vybz Hub.
Currency or provider availability may differ by sales channel.
The promoter must not represent an unsupported payment method or currency as available.
11. Ticket Inventory
Vybz Hub maintains ticket inventory using server-side controls designed to reduce overselling.
The promoter must not manipulate quantities, bypass inventory controls, directly modify issued tickets, or circumvent Vybz Hub’s authorized ticketing processes.
12. Event Staff
A promoter may authorize eligible event staff for supported roles such as scanning, door sales, or management.
The promoter is responsible for granting access only to authorized personnel and revoking access when no longer needed.
Staff access is event-specific and must not be shared or used to access unrelated events.
13. QR Scanning and Check-In
Vybz Hub tickets may use unique digital credentials.
Promoters and authorized staff may use Vybz Hub’s scanner to validate tickets for the assigned event.
Promoters must not collect, copy, publish, retain unnecessarily, or misuse customer QR credentials.
14. Transfers and Attendee Names
Where enabled, customers may transfer eligible tickets or change attendee names through Vybz Hub.
A valid completed transfer may change the current ticket owner and rotate the ticket credential.
Promoters must rely on current ticket state in Vybz Hub rather than screenshots or outdated credentials.
15. Refunds for Transferred Tickets
If an electronically purchased ticket has been transferred and later becomes eligible for refund, the refund is generally returned to the original payment method used by the original purchaser.
The transferred ticket may be automatically cancelled or voided. The current recipient does not become the payment recipient solely because the recipient currently owns the ticket.
Promoters should not instruct recipients to demand reimbursement from Vybz Hub for separate off-platform payments between users.
16. Event Changes, Postponements, Reschedules, and Relocations
Promoters must promptly update Vybz Hub and attendees when an event is postponed, rescheduled, relocated, or materially changed.
A changed event is not automatically cancelled. Existing tickets may remain valid unless Vybz Hub or the promoter, through an authorized process, provides a refund, credit, exchange, or other remedy.
Promoters must not use a date/venue edit to evade cancellation/refund obligations where the change is materially equivalent to cancellation or where law requires a remedy.
17. Payout Eligibility
Electronic ticket proceeds collected by Vybz Hub are not immediately payable to the promoter.
Subject to successful payment, event completion, financial reconciliation, disputes, refunds, liabilities, and holds, promoter funds become eligible for payout after the configured post-event holding period.
The current business rule is a 5-business-day post-event holding period, with operational payout completion potentially taking additional time depending on payout method, banking processing, review, holidays, weekends, financial holds, and required verification.
The app may communicate an expected overall availability/processing window consistent with the platform’s current 5–7 business day operational expectation.
Eligibility does not guarantee release while a valid financial hold, dispute, refund obligation, compliance review, or promoter liability remains unresolved.
18. Payout Requests and Accounts
Promoters must provide accurate payout information for the selected currency and supported payout method.
Vybz Hub may require verification before releasing funds.
A promoter is responsible for losses, delays, or failed transfers caused by inaccurate payout information supplied by the promoter, except to the extent caused by Vybz Hub’s own error.
19. No Double Payment
Vybz Hub may use transaction locking, payout statuses, ledger records, and other controls to prevent duplicate payouts.
A promoter is not entitled to receive the same proceeds more than once.
If an overpayment occurs, Vybz Hub may offset the amount against future amounts owed to the promoter or pursue other lawful recovery methods.
20. Event Cancellation Requests
If an event has ticket sales, the promoter must not simply delete the event or attempt to bypass ticket obligations.
The promoter must submit an event-cancellation request through Vybz Hub.
Cancellation may require administrative review before refund processing begins.
21. Refund Responsibility for Cancelled Events
If a promoter cancels an event, the promoter accepts responsibility for refund obligations associated with that cancellation to the extent permitted by law and this Agreement.
For eligible electronic payments collected through Vybz Hub, Vybz Hub may process customer refunds through the applicable payment provider.
For an approved full cancellation refund, the platform may return the eligible amount originally charged to the customer for the affected ticket, including the applicable customer ticket fee, subject to prior refunds, disputes, chargebacks, provider limitations, and law.
The promoter is responsible for fees, liabilities, losses, or amounts attributable to promoter-caused refunds to the extent allowed by law and reflected in the applicable payment/ledger arrangement.
22. Door-Cash Refunds
Because Vybz Hub does not collect or hold door cash, Vybz Hub cannot return money it never received.
The promoter is responsible for refunding eligible door-cash customers following a cancelled event or other circumstance where a cash refund is legally or contractually required.
23. Disputes and Chargebacks
Electronic ticket payments may be disputed or charged back.
The promoter agrees to reasonably cooperate with requests for event or transaction evidence.
Where a dispute, chargeback, refund, or related loss is attributable to the event or promoter, Vybz Hub may place a payout hold, reduce eligible payout amounts, create a promoter liability, offset amounts against future proceeds, delay payout while the matter is investigated, or pursue lawful recovery of amounts already paid to the promoter.
24. Setoff, Recovery, and Reserves
To the extent permitted by law, Vybz Hub may offset valid promoter liabilities against current or future promoter proceeds, pending payouts, amounts otherwise payable, or other platform-held promoter funds.
These liabilities may include approved refunds, chargebacks, duplicate payouts, overpayments, unrecovered payment losses, promoter-caused cancellation costs, or other amounts validly owed under this Agreement.
Where reasonably necessary because of material financial risk, Vybz Hub may maintain a temporary hold or reserve consistent with the platform’s financial-hold process.
25. Financial Holds
Vybz Hub may place a reasonable hold on promoter funds where necessary because of pending refunds, event cancellation, payment disputes, suspected fraud, abnormal transaction activity, legal/compliance requirements, unresolved promoter liabilities, or other material financial risk.
A hold does not transfer ownership of funds to Vybz Hub and will be handled according to the applicable transaction status, obligations, and law.
26. Taxes
The promoter is responsible for determining and satisfying taxes, duties, permits, levies, reporting obligations, or similar obligations applicable to the promoter’s event or income, except for taxes that Vybz Hub is legally required to collect, report, or remit itself.
Attorney/accounting review required: confirm Jamaica and U.S./international tax treatment for the final operating structure.
27. Accurate Information and Customer Communications
Promoters must provide accurate event and contact information and promptly communicate material event changes through available Vybz Hub tools where appropriate.
Promoters must not intentionally mislead purchasers about performers, venue, date, ticket benefits, capacity, age restrictions, accessibility, or other material event terms.
28. Event-Specific Admission Rules
Promoters may establish lawful event-specific rules regarding age, identification, safety, security, dress, entry cutoff, prohibited items, and other admission requirements.
Rules must be disclosed where reasonably practicable, applied lawfully, and may not override mandatory consumer law or Vybz Hub platform rules.
29. Prohibited Events and Conduct
Promoters must comply with the Acceptable Use & Prohibited Events Policy.
Promoters may not create fraudulent or fictitious events, sell tickets without authority, manipulate inventory or check-ins, evade fees through unauthorized payment methods, use door cash records to disguise electronic sales, misuse customer personal information, copy or expose ticket security credentials, circumvent cancellation/refund workflows, attempt duplicate payouts, or use Vybz Hub for unlawful events or transactions.
30. Records and Audit Trail
Vybz Hub may retain ticket, payment, payout, refund, transfer, check-in, staff, cancellation, liability, dispute, and audit records as reasonably necessary for platform operations, fraud prevention, accounting, legal compliance, and dispute resolution.
31. Suspension of Ticketing or Payouts
Vybz Hub may restrict ticket sales, promoter access, or payouts where reasonably necessary because of fraud, security risk, unresolved financial obligations, material violations, unlawful activity, or threats to customers or platform integrity.
32. Force Majeure and External Events
Events may be affected by weather, government orders, venue closures, public-safety conditions, performer issues, transportation disruptions, utility failures, or other events outside a party’s reasonable control.
Such circumstances do not automatically eliminate refund or consumer obligations that apply by law or Vybz Hub policy. Promoters remain responsible for promptly communicating event status and following the authorized cancellation/change workflow.
33. No Guaranteed Sales
Vybz Hub does not guarantee ticket sales, attendance, revenue, event success, advertising performance, or profitability.
34. Changes to This Agreement
Vybz Hub may update this Agreement.
Where the application uses versioned acceptance, a promoter may be required to accept the current version before enabling ticketing for a new event or continuing certain ticketing functions.
Prior acceptance records should be preserved for audit/history.
35. Governing Law and Promoter Disputes
This Agreement is governed by the law applicable to the Vybz Hub operating entity, subject to laws that cannot be contractually waived.
